ble standard prescribed under this chapter without

prior notice and comment and on terms the Sec-

retary considers appropriate if the Secretary deter-

mines that—

‘‘(A) it is in the public interest to grant
21
the waiver;

‘‘(B) the waiver is not inconsistent with
23
the safety of transporting hazardous materials;
24
and
