served under subsection (h)(2) for the

surface transportation block grant

program; by

‘‘(ii) the share for each State, which

shall be equal to the proportion that—

‘‘(I) the amount of apportion-
13
ments that the State received for fis-
14
cal year 2015; bears to
15
‘‘(II) the amount of those appor-
16
tionments received by all States for
17
that fiscal year.

initial amounts resulting from the calculation

under subparagraph (A) shall be adjusted to

ensure that each State receives an aggregate

apportionment equal to at least 95 percent of

the estimated tax payments attributable to

highway users in the State paid into the High-

way Trust Fund (other than the Mass Transit
