‘‘(2) the lead authority follows the cooperating

authority’s implementing regulations or procedures

under such Act; and

‘‘(3) the lead authority determines that—

‘‘(A) the proposed multimodal project does

not individually or cumulatively have a signifi-

cant impact on the environment; and

‘‘(B) extraordinary circumstances do not

exist that merit additional analysis and docu-

mentation in an environmental impact state-

ment or environmental assessment required

under such Act.’’; and

(4) by striking subsection (d) and inserting the

Section 327 of title 23, United States Code, is

amended—

(1) in subsection (a)(2)(B)(iii) by striking ‘‘(42
24
U.S.C. 13 4321 et seq.)’’ and inserting ‘‘(42 U.S.C.
25
4321 et seq.)’’;
